{"id":292,"date":"2026-08-17T10:01:32","date_gmt":"2026-08-17T10:01:32","guid":{"rendered":"https:\/\/blazepointmedia.com\/?p=292"},"modified":"2026-08-17T10:03:19","modified_gmt":"2026-08-17T10:03:19","slug":"gachagua-takes-impeachment-battle-to-court-of-appeal","status":"publish","type":"post","link":"https:\/\/blazepointmedia.com\/?p=292","title":{"rendered":"Gachagua Takes Impeachment Battle to Court of Appeal"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">NAIROBI, Kenya \u2014 Former Deputy President Rigathi Gachagua has moved to the Court of Appeal to challenge a High Court decision that upheld his impeachment and removal from office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his appeal, Gachagua argues that the three-judge High Court bench erred in law by holding that the Senate\u2019s resolution to remove him from office could not be reversed, despite finding that aspects of the impeachment proceedings violated his constitutional rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court, in a judgment delivered on June 8, 2026, upheld the Senate\u2019s decision to impeach Gachagua. However, Justices Eric Ogola, Antony Mrima and Fred Mugambi found that his right to a fair hearing had been violated after the Senate declined to grant an adjournment when he was absent from the proceedings on medical grounds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court awarded Gachagua KSh50 million in constitutional damages, saying the award was intended to vindicate the Constitution, restore his dignity and deter future violations of constitutional rights.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"474\" src=\"https:\/\/blazepointmedia.com\/wp-content\/uploads\/2026\/08\/1002060300-1024x474.jpg\" alt=\"\" class=\"wp-image-295\" srcset=\"https:\/\/blazepointmedia.com\/wp-content\/uploads\/2026\/08\/1002060300-1024x474.jpg 1024w, https:\/\/blazepointmedia.com\/wp-content\/uploads\/2026\/08\/1002060300-300x139.jpg 300w, https:\/\/blazepointmedia.com\/wp-content\/uploads\/2026\/08\/1002060300-768x356.jpg 768w, https:\/\/blazepointmedia.com\/wp-content\/uploads\/2026\/08\/1002060300.jpg 1080w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Gachagua is now challenging the judges\u2019 interpretation of Article 145 of the Constitution, which provides for the removal of a Deputy President from office through impeachment.
